FAQ                                                                                                                                                           Whenever a patient decides to undergo major surgery, they’re taking a risk. Hip replacement patients trust that the results will improve their lives and cut down on pain enough to be worth the discomfort, inconvenience and risk. They trust that the prosthesis they’re having implanted has been proven safe and is a state of the art product. But that’s not always the case. In recent years, faulty hip devices have necessitated thousands of revision surgeries and prompted lawsuits, causing many to worry that metal on metal hip implant aren’t safe.
One example of a company who has come under fire for making faulty products is DePuy. They have been sued over 11,000 times by recipients of one of their metal on metal hip systems who had the device fail prematurely, and in 2013, the company paid $7 billion to settle a portion of the suits. Another wave of lawsuits happened with their UltraMet product; they have been ordered by a court to pay 500 million in damages so far.
Other companies that have been sued include Zimmer, Stryker, BioMet, Smith & Nephew and OMNI. Fifteen different models of metal on metal implants have been the subject of suits, suggesting how widespread problems are in different devices made by different companies.
Reasoning for the lawsuits include severe pain, loosening of the device, bone damage, metal poisoning and failure of the implant.  All of these are associated with metal because of its especially harmful effect on human tissues.  When metal particles come loose due to wear, they build up in the joint and cause irritation and inflammation of nearby tissues, including bone. When bone is damaged, the implants cemented to it can begin to come loose.
Metallosis, or metal poisoning, can also be a reason for revision surgery. In this complication, metal ions that leach into the bloodstream create inflammation and oxidation throughout the body, causing negative mental, cognitive, digestive and other symptoms. The only effective treatment is to remove the source of the toxin.
A lawsuit against a device manufacturer can only succeed if courts determine the company knew the risk of the product and proceeded anyway, or did not take enough action to avoid risk.  This has often been determined to be the case. Many have also been recalled. The FDA website lists possible risks of metal on metal, but stops short of recommending against any of them; however, health authorities in England have recommended against metal on metal implants with a large ball size.
