When a medical device is alleged to be defective or harmful, it’s crucial that it be recalled as soon as possible before many people have had a chance to be harmed by it. In recent years, over a dozen types of metal on metal hip implants have been recalled after evidence has come out of high levels of premature failure.

Recalls can be initiated by a company itself or ordered by the FDA. When the recall begins, the company ceases manufacturing the product, destroys unsold ones and notifies others in the supply chain so they can get a refund for unused devices.  But for patients who have already had a defective artificial joint implanted, the situation is murkier. They must watch and wait for adverse effects, and they may consider filing a lawsuit to get compensation for pain, suffering and medical expenses.  Stryker, one of the largest medical supply companies, has recalled multiple metal on metal hip implant models. One is the Rejuvenate ABG II. It is made from cobalt, chromium and titanium. It differs from others because it is a modular system, with multiple neck and stem options to make sizing easier. The stem is the part of the implant that is inserted into the femur, while the neck is the part that protrudes from it and holds the hip ball. Evidence as shown that extra wear occurs where the neck meets the stem.
The company recalled the product in 2012 after evidence showed high levels of corrosion and fretting, or particle wear. As with other metal on metal devices, it was causing metallosis and excessive metal buildup and tissue irritation in surrounding tissue.

Thousands of lawsuits have been filed against Stryker, claiming not only that the product is harmful but that they misleadingly claimed the components were resistant to corrosion and wear.  Some plaintiffs had to have revision surgery in as little as 15 months. Many of the lawsuits were settled in 2014, but it is likely that more will emerge as the implants continue to cause problems.
